أثر العقوبات الآقتصادية الدولية على حق الشعوب في التنمية

Abstract

الملخص: تم ومن خلال هذه الدراسة التطرق إلى موضوع العقوبات الاقتصادية الدولية باعتبارها جزاء غيرعسكري تلجأ إليه دولة ما ضد دولة أخرى منتهكة لأحكام القانون الدولي، بهدف إرغامها على تعديل سلوكها وإصلاح الضرر الذي نجم عن هذا السلوك المخل. غير أن هذه الإجراءات وعلى الرغم من أهميتها في حماية قواعد القانون الدولي من الانتهاك وضرورياتهاكآلية لحفظ السلم والأمن الدوليين إلا أنها اصطدت بمنطق حماية حقوق الإنسان، فمن جهة نجد أنالميثاق يؤكد على ضرورة اتخاذ كافة التدابير اللازمة لحماية حقوق الإنسان كالعقوبات الاقتصادية، ومن جهة أخرى نجد أنه يمص على حماية حقوق الإنسان وحق الشعوب في تحقيق تنميتها. ومما لاشك فيه هو أن ولهذه الإجراءات أثار سلبية على حقوق الإنسان عامة والحق في التنمية كمحور من محاور حقوق الإنسان، إذ أثبت الواقع العملي أن هذه الإجراءات قد أضرت بحقوق الإنسان دون أن تحدث تغيير منشود بالضغط على الحكام، نتيجة لتلك القرارات الغير مشروعة التي اتخذها مجلس الأمن ضد بعض الدول، هذا ما جعل أمر البحث عن الحل البدل أمر ضروري من أجل التخفيف من تلك الآثار التي سببتها العقوبات الاقتصادية الشاملة. الكلمات المفتاحية:الجزاء الدولي- العقوبات الاقتصادية الدولية- الحصار الاقتصادي- الحظر الاقتصادي- المقاطعة الاقتصادية- الحق في التنمية Résumé : Cette étude aborde le sujet des sanctions économiques internationales, qui sont considérées comme des sanctions non militaires qui sont utilisées par un État contre un autre en violant les dispositions du droit international afin de l'obliger à en ajuster le comportement et à réparer les dommages causés par ce fait conduite incorrecte. Malgré l’importance de ces mesures pour protéger les dispositions du droit international contre toute violation et pour préserver la paix et la sécurité internationales, elles se heurtent à la logique de la protection des droits de l’homme.D'un côté, nous observons que la charte insiste sur la nécessité de prendre toutes les mesures nécessaires pour préserver les droits de l'homme, telles que les sanctions économiques. D’un autre côté, nous observons également que la charte prévoit le droit des peuples à réaliser le développement. Sans aucun doute, ces mesures ont des effets pratiquement négatifs sur les droits de l'homme en général et sur le droit au développement en particulier, en tant que domaine d'intervention, sans apporter le changement souhaité ni en exerçant des pressions sur les dirigeants ni en rendant inéligibles les décisions prises par le Conseil de sécurité des Nations Unies contre certains États.Il est donc nécessaire de rechercher d’autres solutions pour atténuer les lourdes sanctions économiques. Abstract: This study addresses the topic of the International Economic Sanctions, which are regarded as non-military sanctions that are used by one state against another one violating the International Law’s provisions for the sake of obliging it to adjust its conductand repair the damage caused by this incorrect conduct. Despite the importance of these measures in protecting the International Law’s terms from being violated and its necessity in maintaining the international peace and security, they collide with the logic of protecting the human rights. From one side, we observe that the charter insists on taking all the necessary measures for preserving the human rights such as the economic sanctions.From another side, we observe also that the charter provides for the peoples’ right in realising development. With no doubt, these measures has practically negative effects on the human rights in general and on the right of development in particular, as an area of focus, without bringing about the desired change neither through putting the rulers under pressure nor through the ineligible decisions taken by the UN Security Council against some states. So, looking for other alternative solutions is necessary for the mitigation of massive economic sanctions.
