المسؤولية الإدارية الناجمة عن أضرار الأشغال العمومية في التشريع الجزائري

Abstract

المــلخص: تدور هذه المذكرة حول موضوع المسؤولية الإدارية الناجمة عن أضرار الأشغال العمومية في التشريع الجزائري. من خلال دراستنا لهذا الموضوع دراسة وصفية تحليلية تم التوصل إلى: إن القضاء الإداري أخذ بعين الاعتبار معيار صفة الضحية الذي يعتبر الأساس القانوني لإقرار المسؤولية، وتبين أن الأضرار الواقعة على الغير تقوم على أساس المخاطر، والأضرار الواقعة على المشاركين قوم على أساس الخطأ، إلى ان الأضرار الواقعة على المرتفق قيمت على أساس خطأ انعدام الصيانة، وهو خطأ مفترض في مواجهة الإدارة؛ لذا أوجد المشرع الجزائري أساس قانوني لجبر الأضرار التي تسببها الأشغال العمومية حيث لا يتم منح التعويض إلى على الضرر الذي أصاب المضرور، وتقدير مبلغ التعويض يكون حسب ما يراه مناسبا لجبر الضرر. الكلمات المفتاحية: 1/..المسؤولية الإدارية.... 2/..خطأ مرفقي..... 3/..العلاقة السببية. 4/...الخطأ الشخصي.... 5/.الضرر... 6/.التعويض.....

Abstract of The master thesis This memorandum revolves around the issue of administrative liability resulting from public works damages in Algerian legislation. Through our study of this topic, a descriptive and analytical study has been reached: The administrative judiciary took into account the victim status criterion, which is the legal basis for establishing liability, and it was found that the damages incurred on third parties are based on risks, and the damages incurred on the participants are based on fault, until the damages incurred on the escort were assessed on the basis of the lack of maintenance, which is assumed error in the face of management; Therefore, the Algerian legislator created a legal basis for reparation for the damages caused by public works, where compensation is only granted to the damage suffered by the victim, and the amount of compensation is estimated according to what it deems appropriate to compensate the damage. keywords: 1/ administrative liability ; 2/ elbow error ; 3/ the causation ; 4/personal error ; 5/ the victim ; 6/.compensation.
