Abstract

The subject of ways of social security debtsand duties collection in the Algerian legislation takes a significant importance, that is manifested in the role of social security contributions and which are considered as the funderof social security funds.This means that the sustainability of resources and the equitable distribution through her contributions in cash and kind is closely related to the extent of collect of social security institutions of his duties or not. Keeping the financial balance of the social security funds is one of the government's priorities in order to succeedits social policy, and it depends on the respect ofthe contributors to the social security for their obligations or not.Therefore, the legislator has ensured a legal protection of social security duties by enabling them by special techniques and mechanisms of recovery in case of breach of their obligations established under Law No 83/14 as amended and supplemented. Consequently, the problematic of this study was centered on what are the ways and means granted to the social security authority in the recovery of its debts? Their effectiveness? And what are the facing obstacles during followingthese methods? In order to broach the problematic we've divided our research into two sections, the first one is the administrative procedures for forced collect, whereas the second, we have discussed the legal guarantees for compulsory collection. We have tried to address this issue in addition to the monetary approach to the analytical approach through legal texts and analysis, and especially the law No. 08/08 relating to disputes in the field of social security, the law No. 83/14 aforementioned, as well as,the decrees and orders relating to these two laws.
