Résumé:
The Algerian legislator walked pats on the doctrine and jurisdiction, by establishing
civil responsibility for traffic motor accidents on an objective basis, which is to provide
compensation to the victim or his heirs in all cases. The legislator also left the estimation
of compensation to a predefined table and not to the discretion of the judge, and that
since the Ordinance No74/15on compulsory motor insurance and the compensation of
corporal damages, amended and supplemented by the law 88/31; especially after the
publication of its executive decree in 1980.From then on the right to compensation for
corporal damages is not built on the system of traditional civil responsibility based on
fault anymore.
