الأليات القانونية لحماية براءات الإختراع في القانون الجزائري

Abstract

ملخص الدراسة: تتناول هذه الدراسة موضوع الآليات القانونية لحماية براءات الاختراع في القانون الجزائري، من خلال تسليط الضوء على الإطار المفاهيمي لبراءة الاختراع وشروط وإجراءات الحصول عليها، إضافة إلى الآثار القانونية المترتبة عنها. كما تبحث الدراسة في مختلف صور الحماية المدنية والجزائية التي أقرها المشرع الجزائري لحماية حقوق المخترعين، وتهدف إلى تقييم مدى فعالية هذه الآليات في ضمان الحماية القانونية للابتكار وتشجيع الإبداع العلمي والتقني. وقد توصلت الدراسة إلى أن المشرع الجزائري وفر إطارا قانونيا متكاملا نسبيا، غير أن فعاليته تبقى مرتبطة بمدى التطبيق الفعلي لهذه النصوص

This study addresses the legal mechanisms for protecting patents under Algerian law by highlighting the conceptual framework of patents, as well as the conditions and procedures for obtaining them, in addition to their legal effects. It also examines the various civil and criminal protection measures established by the Algerian legislator to safeguard inventors’ rights. The study aims to evaluate the effectiveness of these mechanisms in ensuring legal protection for innovation and promoting scientific and technological creativity. The findings indicate that the Algerian legislator has provided a relatively comprehensive legal framework; however, its effectiveness remains dependent on the practical implementation of these provisions
