التصرف في العقار بالبيع والاكتساب الملكية العقارية

Abstract

مــلخص مذكرة الماستر تتناول هذه الدراسة موضوع التصرف في العقار بالبيع واكتساب الملكية العقارية في التشريع الجزائري، باعتباره من المواضيع القانونية المهمة التي ترتبط بحماية الحقوق العينية وتحقيق الاستقرار في المعاملات العقارية. وقد هدفت الدراسة إلى بيان الأحكام القانونية المنظمة لعقد بيع العقار، وشروط صحته، والآثار المترتبة عنه، إضافة إلى توضيح الطرق القانونية لاكتساب الملكية العقارية ودور الرسمية والشهر العقاري في نقل الملكية وحماية المتعاملين. واعتمدت الدراسة على المنهج الوصفي من خلال عرض المفاهيم والنصوص القانونية المتعلقة بالتصرفات العقارية، والمنهج التحليلي لتحليل مختلف الأحكام القانونية المنظمة للبيع العقاري واكتساب الملكية في القانون الجزائري، مع إبراز أهم الإشكالات العملية والقضائية المرتبطة بها. وقد توصلت الدراسة إلى أن المشرّع الجزائري شدّد على ضرورة احترام الرسمية والشهر العقاري كشرطين أساسيين لنقل الملكية العقارية، لما لهما من دور في تحقيق الأمن العقاري والحد من النزاعات. كما أظهرت الدراسة أن التطورات الحديثة، خاصة الرقمنة وتحديث السجل العقاري، ساهمت في تحسين تسيير المعاملات العقارية وتعزيز الشفافية، رغم استمرار بعض الصعوبات العملية المرتبطة بالإجراءات الإدارية والعقود العرفية. وفي ضوء ذلك، خلصت الدراسة إلى ضرورة تعزيز الحماية القانونية للملكية العقارية، وتبسيط الإجراءات المتعلقة بالتوثيق والشهر العقاري، مع مواصلة تحديث المنظومة العقارية بما ينسجم مع التطورات القانونية والتكنولوجية الحديثة

This study addresses the topic of real estate disposition through sale and acquisition of real property ownership in Algerian legislation, as it is considered one of the important legal subjects related to the protection of property rights and the stability of real estate transactions. The study aimed to clarify the legal provisions governing real estate sale contracts, their validity conditions, and their legal effects, in addition to explaining the legal methods of acquiring real estate ownership and the role of official documentation and land registration in transferring ownership and protecting contracting parties. The study relied on the descriptive method by presenting the legal concepts and provisions related to real estate transactions, and on the analytical method by analyzing the legal rules governing real estate sales and ownership acquisition under Algerian law, while highlighting the most important practical and judicial issues related to them. The study concluded that the Algerian legislator emphasized the necessity of official authentication and land registration as essential conditions for transferring real estate ownership, due to their important role in ensuring legal security and reducing disputes. It also showed that modern developments, especially digitalization and the modernization of land registry systems, contributed to improving the management of real estate transactions and enhancing transparency, despite the persistence of some practical difficulties related to administrative procedures and informal contracts. Accordingly, the study recommends strengthening the legal protection of real estate ownership, simplifying procedures related to documentation and land registration, and continuing the modernization of the real estate system in line with modern legal and technological developments
