Abstract

صدر بتاريخ 12 غشت 1913، أول ظهير للالتزامات والعقود بالمغرب، ليحل محل الفقه الإسلامي في تنظيم المعاملات بين المغاربة والأجانب المقيمين بالمغرب، حيث عملت سلطات الحماية الفرنسية على اعتماد المجلة التونسية للالتزامات كمرجع أساسي لوضع مشروع ظهير الالتزامات والعقود، وذلك بعد نجاح التجربة التونسية، المتمثلة في اعتماد سلطات الحماية الفرنسية في تونس، على سنّ ترسانة قانونية عصرية ، وقد حرصت سلطات الحماية الفرنسية على أن لا تتعارض أحكام المجلة مع أحكام الشريعة الإسلامية. :Abstract Issued on 12 August 1913, the first dahir of the obligations and contracts in Morocco, to replace the Islamic jurisprudence in the regulation of transactions between Moroccans and foreigners residing in Morocco, where the French protection authorities adopted the Tunisian Journal of Obligations as the main reference for the draft dahir obligations and contracts, after the success of the Tunisian experience, In the adoption of the French protection authorities in Tunisia, the establishment of a modern legal arsenal, and the French protection authorities were keen not to contradict the provisions of the magazine with the provisions of Islamic law
