Abstract

Abstract : This study aims to examine electronic contracting in the field of public procurement as one of the most significant manifestations of digital transformation adopted by public administrations to enhance the efficiency of public services, promote transparency and competition, and rationalize public spending. The study focuses on analyzing the legal and regulatory framework governing the electronic conclusion of public contracts, while explaining the different stages of electronic procurement, starting from the publication of tender notices, through the submission and evaluation of bids, and ending with the award and execution of public contracts. The study also discusses the extent to which electronic contracting complies with the fundamental principles of public procurement, particularly the principles of equality among economic operators, free access to public procurement, and procedural transparency. Furthermore, it addresses the technical and legal mechanisms used to ensure the validity and security of electronic transactions, especially electronic signatures, data protection, and information security. The study concludes that the adoption of electronic contracting in public procurement contributes to accelerating administrative procedures, reducing costs, and limiting unlawful practices. However, its success remains dependent on the availability of advanced digital infrastructure, the qualification of human resources, and the continuous development of legal frameworks to keep pace with modern technological advancements.
