إجراءات المتابعة أمام وكيل الجمهورية في ظل القانون رقم 25-14

Abstract

تناولت هذه الدراسة الآليات المستحدثة للمتابعة الجزائية أمام وكيل الجمهورية في ظل القانون رقم 14-25 المتضمن قانون الإجراءات الجزائية الجديد حيث تكمن أهمية البحث في تسليط الضوء على الازدواجية الإجرائية التي اعتمدها المشرع تحت مسمى " الإخطار الفوري أمام المحكمة والتي تجمع بين نظامين متكاملين نظام المثول الفوري المخصص للقضايا المهيأة للفصل ونظام إجراءات الجنح المتلبس بها أين يقتصر الأمر فيها على التلبس بالجريمة وقد عالجت الدراسة إشكالية التوازن الصعب بين رغبة المشرع في تكريس العدالة والسرعة فيالفصل من جهة وبين ضرورة صون ضمانات المحاكمة العادلة وحماية قرينة البراءة من جهة، لاسيما في ظل استعادة وكيل الجمهورية لسلطة إصدار أوامر الإيداع الاستثنائية. وخلصت الدراسة إلى أن المشرع الجزائري ومن خلال تجاوزه للعقبات العملية التي طرحها تعديل 2015 الملغى قد وضع إطاراً قانونياً دقيقاً يضبط معايير اللجوء لكل إجراء

: This study examines the newly introduced mechanisms for criminal prosecution before the public prosecutor under law no.25/14, amending and supplementing the code of criminal procedure.The significance of this research lies in shedding light on the procedural duality adopted by the legislature under the mechanism of “Immediate Notification to the court(l’avisement immédiat).This mechanism merges two complementary systems: the immediate appearance system, designated for cases ready for adjudication, andthe in flagrante delicto misdemeanor procedures, which are strictly limited to red-handed offenses. Furthemore, the study addresses the problematic of the delicate balance between the legislature’s desire to achieve swift justice and expedite rulings on one hand, and the necessity of safeguarding fair trial guarantees and protecting the presumption of innocence on the other- particularly in light of the public prosecutor reinstating the authority to issue exceptional remand orders. The study concludes that the Algerian legislature, by overcoming the practical obstacles raised by the repealed 2015 amendment, has established a precise legal framework that regulates the criteria for resorting to each respective procedure
