Abstract

This dissertation examines judicial evidence in cybercrimes and its evaluation, as one of the most significant contemporary legal issues resulting from the rapid development of information and communication technologies. The study aims to highlight the specific nature of cybercrimes and assess the effectiveness of judicial evidence in detecting and proving such crimes, with particular emphasis on electronic evidence as the primary means of proof in the digital environment. The research adopts an analytical approach through the examination of legal texts governing digital evidence, in addition to a descriptive approach to explain concepts related to cybercrime and digital evidence. The study addresses the legal value of electronic evidence, procedures for collecting and analyzing digital evidence, the role of judicial authorities and digital forensic experts in cybercrime investigations, as well as the practical challenges facing criminal proof in cyberspace. The study concludes that electronic evidence has become a fundamental component of modern criminal proof. However, its effectiveness depends on the legality of its collection, preservation, and analysis, as well as the availability of technical and legal expertise. The research also emphasizes the need to update national legislation, strengthen international cooperation, and enhance digital forensic capabilities to effectively combat cybercrime and ensure the proper administration of justice in the digital age.
