الحماية القانونية للبيانات الشخصية في التشريع الجزائري

Abstract

ملخص الدراسة: تهدف هذه الدراسة إلى تسليط الضوء على الحماية القانونية للبيانات الشخصية في ظل التطور الرقمي المتسارع، من خلال تحليل الإطار التشريعي المنظم لمعالجة المعطيات ذات الطابع الشخصي في الجزائر، وبيان الآليات القانونية والمؤسساتية المكرسة لحمايتها، كما تتناول الدراسة أهم الضمانات القانونية المقررة للأفراد في مواجهة مخاطر الاستخدام غير المشروع للبيانات، مع إبراز دور السلطة الوطنية والجهات القضائية في تحقيق هذه الحماية، وقد خلصت الدراسة إلى أن المنظومة القانونية رغم تطورها ما تزال بحاجة إلى تعزيز وتكييف مستمر لمواكبة التحولات التكنولوجية وضمان حماية فعلية وفعالة للمعطيات الشخصية

This study aims to highlight the legal protection of personal data in light of the rapid digital development, through analyzing the legislative framework governing the processing”of personal data In Algeria and identifying the legal and Institut”onal’mechanisms established to protect it. It also examines the main lega” guarantees granted to Individuals against the misuse of their data, while’emphasizing the role of the national authority and judicial bo”Ies in ensuring such protection. The study concludes that, despite the development of the legal framework, it still requires continuous improvement and adaptation to technological changes to ensure effective protection of personal data
