Abstract
تتناول هذه المذكرة موضوع محكمة التنازع في النظام القضائي الجزائري باعتبارها هيئة قضائية مستقلة أُنشئت للفصل في منازعات الاختصاص بين القضاء العادي والقضاء الإداري في ظل نظام الازدواجية القضائية المعتمد في الجزائر. وقد هدفت الدراسة إلى إبراز دور محكمة التنازع في ضمان حسن توزيع الاختصاص القضائي وتحقيق الأمن القانوني والقضائي للمتقاضين.
اعتمدت الدراسة على المنهج الوصفي التحليلي من خلال تحليل النصوص الدستورية والتشريعية المنظمة لمحكمة التنازع، وعلى رأسها القانون العضوي رقم 03-98 المتعلق باختصاصاتها وتنظيمها وعملها. كما تطرقت إلى نشأة المحكمة وتطورها وخصائصها وتشكيلتها البشرية وآليات سيرها وإجراءات الفصل في منازعات الاختصاص وتناقض الأحكام.
وتوصلت الدراسة إلى أن محكمة التنازع تمثل ضمانة أساسية لتحقيق التوازن بين القضاء العادي والقضاء الإداري، ومنع إنكار العدالة وتفادي تضارب الأحكام، غير أن بعض الجوانب التنظيمية والإجرائية ما تزال بحاجة إلى تطوير لتعزيز فعاليتها وتحقيق حماية أكبر لحقوق المتقاضين
This dissertation examines the Court of Conflicts in the Algerian judicial system, an independent judicial body responsible for resolving jurisdictional disputes between ordinary courts and administrative courts within Algeria’s dual judicial system. The study aims to highlight its role in ensuring the proper distribution of judicial jurisdiction and strengthening legal and judicial certainty for litigants.
The research adopts a descriptive and analytical approach based on the examination of constitutional and legislative texts governing the Court of Conflicts, particularly Organic Law No. 03-98. It explores the court’s origins, development, characteristics, composition, operational framework, and procedures for resolving jurisdictional disputes and conflicting judicial decisions.
The study concludes that the Court of Conflicts serves as a fundamental safeguard for maintaining balance between the ordinary and administrative judicial systems, preventing denial of justice, and avoiding contradictory judgments. Nevertheless, some organizational and procedural aspects require further development to enhance the court’s effectiveness and improve the protection of litigants’ rights.
