In the absence of an enforceable instrument, compulsory enforcement cannot be commenced. To enable the beneficiary of an enforceable instrument to recover his or her claim through compulsory enforcement, the legislator has established legal mechanisms and procedural steps that must be followed in chronological and legal order. Accordingly, the holder of the enforceable instrument is required to comply with the preliminary enforcement procedures before initiating compulsory enforcement. In consideration of these requirements and with a view to achieving justice and maintaining a balance between the interests of the parties to the enforcement proceedings, it can be concluded that the Algerian legislator, through the Code of Civil and Administrative Procedure, has established a comprehensive legal framework governing enforcement procedures. Furthermore, enforceable instruments may give rise to enforcement-related disputes that adversely affect the normal course of enforcement proceedings. Anticipating such situations, the legislator has regulated the procedures for resolving enforcement disputes, given that enforceable instruments represent the practical implementation of the operative part of judicial decisions.
