Abstract

ملخص: تشكل مفتشية العمل أحد أهم الآليات القانونية التي اعتمد عليها المشرع الجزائري لضمان احترام التشريع وتنظيم علاقات العمل داخل مختلف القطاعات. وتتوزع مفتشية العمل بين هياكل مركزية تعنى بالتوجيه والتنسيق، وهياكل غير مركزية تضطلع بهام التفتيش الميداني على المستوى الجهوي والولائي. يعد هذا التنظيم من بين الضمانات الأساسية لحماية حقوق العمال، ومراقبة مدى التزام المستخدمين بتشريعات العمل، بالإضافة إلى دورها المحوري في الوقاية من المنازعات المهنية، والعمل على تسويتها وديا سواء كانت منازعات فردية من خلال المصالحة، أو جماعية عبر إجراءات المصالحة والوساطة وكذا التحكيم، من أجل الحفاظ على السلم الحتماعي داخل المؤسسة.

The Labor Inspectorate is one of the most important legal mechanisms adopted by the Algerian legislature to ensure compliance with legislation and regulate labor relations across various sectors. The Labor Inspectorate is structured into central bodies responsible for guidance and coordination, and decentralized bodies tasked with conducting field inspections at the regional and provincial levels. This structure is among the fundamental guarantees for protecting workers' rights and monitoring employers' adherence to labor laws. Furthermore, it plays a pivotal role in preventing and amicably resolving labor disputes, whether individual disputes through conciliation or collective disputes through mediation, arbitration, and other means, in order to maintain social peace within the workplace
