Abstract
Abstract of The master thesis
This study examines commercial leases in Algerian law, focusing on recent legislative amendments up to 2026. Commercial leases are considered one of the most important commercial contracts, playing a pivotal role in regulating economic activity and ensuring the continuity of commercial operations. The research aims to study the legal framework governing commercial leases by analyzing the legislative texts within the Algerian Commercial Code. It identifies the most significant amendments to this system and assesses their contribution to achieving a balance between landlords and tenants.
The study employs a descriptive and analytical approach to describe and analyze the legal rules governing commercial leases. This analysis highlights the characteristics of this contract and identifies the most significant practical challenges posed by the legal texts in their application, particularly concerning renewal, eviction, and compensation for loss of business assets.
The study concludes that the Algerian legislator has sought to develop the legal framework for commercial leases to achieve a degree of balance between the parties. However, practical experience reveals some difficulties related to the interpretation of the texts and variations in judicial interpretation. This necessitates further legislative development to enhance legal certainty and the stability of commercial transactions
