نظام الملكية المشتركة في القانون الجزائري

Abstract

ملخص المذكرة: تعد الملكية المشتركة ذات وضعية عقارية خاصة تفرضها طبيعة العقارات المبنية المقسمة بين عدة أشخاص وفق حصص، حيث يرتكز الاطار القانوني والاسس المنظمة له في التشريع الجزائري على تحديد مفهومها وخصائصها ومشتملاتها، بالتكامل مع بيان أجهزة التسيير التي تقع على عاتقها إدارة هذه العقارات والمتمثلة في التسيير الانتقالي للمرقي العقاري، ومن ثم التسيير الدائم لجمعية العامة للملاك، والمتصرف السنديك كجهاز تنفيذي، ويتعدى الأمر ذلك إلى تفكيك اليات الحماية القضائية لنظام الملكية المشتركة وحقوق الملاك في مواجهة القيود الإجرائية والقانونية لعقد وعملية البناء، ومناقشة تحديات إدارة وصيانة الأجزاء المشتركة في ظل غياب الثقافة القانونية وعوائق العيش المشترك، مع ابراز دور القضاء في فض النزاعات وتحديد المسؤوليات وتوضيح الحماية الاجرائية من خلال استعراض أنواع الدعاوى القضائية الناشئة عن منازعات هذا النظام العقاري الخاص Abstract : Joint real estate ownership is considered a co-ownership system with a special legal status. This status is imposed by the nature of built properties divided among several persons according to shares. Its legal framework and organizing foundations in Algerian legislation focus on defining its concept, characteristics, and components. This is integrated with clarifying the management bodies responsible for administering these properties, which include the transitional real estate developer, the general assembly of owners, and the syndicate manager (syndic) acting as an executive body. Furthermore, it goes beyond that to analyze the mechanisms of judicial protection for the joint ownership system and the rights of owners in the face of procedural and legal constraints for construction contracts. It also discusses the challenges of managing and maintaining common areas in light of the absence of a legal culture and obstacles to cohabitation. Finally, it highlights the role of the judiciary in resolving disputes, determining responsibilities, and clarifying procedural protection by reviewing the types of lawsuits arising from disputes within this private real estate system.
