Abstract

The doctor cannot perform any treatment or surgery unless he gives the patient sufficien t information, including the disease that the patient suffers from and the appropriate treatment for him. In all cases, the doctor is obligated to inform the patient of everything related to his health condition, except for the risks that affect his psychology and prompt him to refuse treatment. The contractual liability of the doctor is the Sound légal basis for forming a valid medical contract that produces its effects. When the doctor breaches his contractual obligations, it leads to his personale liability, through the availa bility of the general elements of contractual liability, which are known as error, damage, and the causal relation ship that connects them. Failure to comply with the doctor's obligation results in a claim for compensation by the patient to compensate for the existing damage
