Abstract
Abstract of Master’s Thesis
This study examines the settlement of intellectual property disputes under Algerian legislation by analyzing the various legal mechanisms adopted by the legislator to resolve disputes arising from infringements of intellectual property rights and assessing their effectiveness in ensuring legal protection for right holders. The study relies on the descriptive and analytical approach through the examination of legal texts governing intellectual property and the analysis of the mechanisms established for the settlement of related disputes.
The research addresses non-judicial dispute settlement methods, namely conciliation, mediation, and arbitration, as alternative mechanisms characterized by flexibility, speed, and confidentiality. It also examines judicial settlement mechanisms through the civil infringement action and its precautionary measures and civil remedies, as well as the criminal infringement action with its constituent elements and penalties aimed at protecting intellectual property rights and deterring infringements.
The study concludes that the Algerian legislator has established a legal framework combining both non-judicial and judicial mechanisms for the settlement of intellectual property disputes, thereby contributing to the protection of intellectual property rights. However, the effectiveness of this protection remains dependent on the continuous development of legislative and procedural rules, the strengthening of judicial specialization, and the adaptation of legal mechanisms to technological and economic developments.
