تتناول هذه الدراسة موضوع الدفوع الموضوعية في الدعوى المدنية من حيث مفهومها وتمييزها عن غيرها من الدفوع، إضافة إلى أنواعها وآثارها القانونية داخل الخصومة القضائية. كما سلطت الضوء على القواعد الإجرائية المنظمة لإثارتها وشروط التمسك بها، ودورها في حماية حقوق الخصوم وتحقيق التوازن بين الأطراف. وتبين من خلال الدراسة أن الدفوع الموضوعية تعد وسيلة فعالة للفصل في النزاع من حيث الموضوع، وتساهم في استقرار الأحكام القضائية وضمان حسن سير العدالة

This study addresses substantive defenses in civil proceedings in terms of their concept and their distinction from other types of defenses, as well as their categories and legal effects within litigation. It also highlights the procedural rules governing their invocation and the conditions required for raising them, along with their role in protecting the rights of litigants and ensuring balance between parties. The study shows that substantive defenses are an effective means for resolving disputes on the merits, contributing to the stability of judicial decisions and the proper administration of justice
