Abstract

المسؤولية المدنية نظام قانوني وجد لتحقيق التوازن بين مصلحة المضرور في الحصول على التعويض و مصلحة في تحديد حدود التزامه، وقد شهدت أحكامها تطورا ملحوظا بفعل التغيرات التي مست مختلف جوانب الحياة، ومع التطور التكنولوجي المتسارع و ظهور تطبيقات الذكاء الاصطناعي، برزت إشكالات قانونية جديدة تتعلق بالأضرار التي قد تنجم عن هذه الأنظمة الذكية ومدى إمكانية إخضاعها للقواعد التقليدية للمسؤولية المدنية، لذلك يتناول هذا البحث تطور المسؤولية المدنية و مراحل تكيفها مع المستجدات الحديثة ،كما يسلط الضوء على أثر الذكاء الاصطناعي في أحكامها من خلال دراسة مدى كفاية القواعد القانونية الحالية لتحديد المسؤول عن الأضرار و ضمان تعويض المتضررين في ظل غياب تنظيم قانوني خاص وشامل لهذه التقنية

Civil liability is a legal system established to maintain a balance between the injured party’s interest in obtaining compensation and the liable party’s interest in defining the limits of their obligation، Its rules undergone significant development as a result of changes affecting various aspects of life، with the rapid advancement of technology and the emergence of artificial intelligence applications،new legal challenges have arisen concerning the damages that may result from these intelligent systems and the extent to which they can be subjected to the traditional rules of civil liability، Accordingly this research examines the evolution of civil liability and stages of its adaptation to modern developments It also highlights the impact of artificial intelligence on civil liability rules by analyzing the adequacy of current legal frameworks in identifying the party responsible for damages and ensuring compensation for victims particulary in the absence of a specific and comprehensive legal regulation governing this technology.
