Abstract

Consequently, the Algerian legislator has enacted specific legislation to regulate this field and mitigate disputes arising from it. The real estate developer is considered the primary and essential actor in the real estate development sector, playing a pivotal and effective role in initiating and completing housing projects.
This central role entails a set of legal responsibilities defined by law, including professional civil liability, administrative responsibility, and criminal liability. In the event of a breach of these responsibilities—which the legislator regards as mandatory obligations—the developer faces legal penalties and procedures stipulated in the law governing real estate development activities. The ultimate goal of these regulations is the State's endeavor to protect the consumer and guarantee their financial and non-financial rights. However, despite these strict legal frameworks, the housing sector continues to face challenges and obstacles due to insufficient oversight of housing projects and a lack of specialized bodies that rigorously monitor this sector
