Abstract

ملخص: لقد حاولت السياسة العقابية في الجزائر مواكبة المدارس الحديثة في العقاب والتي مفادها إصلاح المسجون وتأهيله و إعادة إدماجه في المجتمع مع تحقيق الهدف من العقوبة و الذي هو الردع العام و الخاص وذلك بفتح المجال لما يسمى بالعقوبة البديلة خاصة في حالات العقوبات القصيرة المدة أين استحدثت عقوبة النفع العام كما عززت حقوق الإنسان داخل المؤسسات العقابية من تعليم ورعاية صحية واجتماعية من خلال المراقبة الالكترونية عن طريق السوار الالكتروني فأعطى المشرع الجزائري لإعطاء أهمية كبيرة للفرد المحبوس و محاولة منه لإعادة إدماجه كفرد صالح في المجتمع.

Summary: The penal policy in Algeria has attempted to keep pace with modern schools in punishment, which are based on reforming, rehabilitating, and reintegrating the prisoner into society while achieving the goal of punishment, which is general and special deterrence, by opening the way to what is called alternative punishment, especially in cases of short-term penalties, where the benefit penalty was introduced In addition, human rights have been strengthened within penal institutions, including health and social education and care, through electronic monitoring through the electronic bracelet, so the Algerian legislator has given great importance to the imprisoned individual and his attempt to reintegrate him as a good individual in society. key words : /1 Reintegration /2Punitive Institution /3Parole /4 Electronic monitoring
