Abstract
This dissertation examines the procedures for the transfer of real estate ownership under Algerian legislation, considering it one of the most significant legal issues in the field of real estate transactions due to the legal, economic, and social effects resulting from the transfer of ownership. The study aims to identify the legal framework governing the transfer of real estate ownership through the analysis of relevant legislative and regulatory texts, particularly the provisions of the Civil Code, the Land Orientation Law, and the legislation related to land registration and notarization.
The study found that the transfer of real estate ownership is not achieved merely by the mutual consent of the parties. Rather, it requires the fulfillment of a set of substantive and formal conditions, foremost among them the drafting of an official deed before a competent notary, followed by its registration through land registration procedures in order to produce its legal effects and become enforceable against third parties. The study also highlighted the role played by the notary and the land registrar in ensuring the validity of real estate transactions and achieving legal security in property matters.
Furthermore, the study demonstrated that the land registration system constitutes a fundamental guarantee for the stability of real estate ownership and the protection of real rights through the publicity of real estate transactions and the reduction of ownership-related disputes. The study also emphasized the importance of modernizing the legal and administrative real estate system in line with the requirements of economic development and the achievement of real estate security.
Accordingly, the effectiveness of real estate ownership transfer procedures depends on compliance with the legal rules governing them and on the proper implementation of notarization and land registration mechanisms, thereby ensuring the protection of individual rights and the stability of real estate transactions.
