Given the importance of this right, the first chapter examined the conceptual framework of real property ownership by defining it and presenting its various classifications, including public and private ownership, as well as forms such as co-ownership and waqf (endowment) ownership. The chapter also explored the historical development of land ownership in Algeria, beginning with the Ottoman period, passing through the colonial era, and ending with the post-independence period, highlighting the major transformations that affected the land tenure system. In addition, the chapter discussed the different methods of acquiring ownership, particularly through sale, exchange, and possession. The second chapter focused on the procedures governing the transfer of private real property ownership. It examined the formal requirements necessary for such transfers, emphasizing the official deed as a fundamental element ensuring the validity and evidentiary value of real estate transactions, while also highlighting the role of notarization in property sales. Furthermore, the chapter addressed the procedural requirements of registration and land publication, which are essential for producing the legal effects of property transactions and making them enforceable against third parties, as well as the sanctions resulting from non-compliance with these requirements. Finally, the study examined the legal mechanisms established to protect real property ownership against any form of infringement. These include civil protection through actions such as ownership claims, actions to prevent interference, and actions to stop new works, as well as criminal protection through the penalization of acts that violate property rights. The study also addressed administrative protection measures adopted by public authorities with regard to both urban and agricultural land.
