التدابير القانونية المتعلقة بحماية البيانات الشخصية في الفضاء الرقمي

Abstract

مــلخص مذكرة الماستر تتناول هذه الدراسة موضوع حماية البيانات الشخصية في الفضاء الرقمي باعتباره من أهم التحديات القانونية التي أفرزها التطور التكنولوجي المتسارع وانتشار استخدام وسائل الاتصال الإلكترونية. وتهدف إلى إبراز الإطار القانوني المنظم لحماية البيانات الشخصية، وبيان مختلف التدابير القانونية والتقنية المعتمدة لضمان احترام خصوصية الأفراد وحماية معطياتهم من مخاطر الاعتداء أو الاستغلال غير المشروع. من خلال تحليل النصوص القانونية الوطنية والدولية ذات الصلة، مع الوقوف على الآليات المؤسساتية والإجرائية المقررة لحماية البيانات الشخصية في البيئة الرقمية. كما تطرقت إلى الحقوق المخولة لأصحاب البيانات والالتزامات الواقعة على عاتق الجهات القائمة بمعالجة البيانات، إضافة إلى التحديات التي تواجه تطبيق قواعد الحماية في ظل التطور المستمر للتقنيات الرقمية. أن فعالية حماية البيانات الشخصية في الفضاء الرقمي تتطلب تعزيز المنظومة التشريعية، وتطوير آليات الرقابة والمتابعة، ونشر الوعي القانوني والرقمي لدى الأفراد والمؤسسات، بما يضمن تحقيق التوازن بين الاستفادة من التكنولوجيا الحديثة وصون الحق في الخصوصية

Abstract of The master thesis This study addresses the issue of personal data protection in the digital space as one of the most significant legal challenges resulting from rapid technological development and the widespread use of electronic communication technologies. It aims to highlight the legal framework governing the protection of personal data and to identify the various legal and technical measures adopted to ensure respect for individuals’ privacy and to protect their data from the risks of unlawful infringement or exploitation. The study is based on an analysis of relevant national and international legal texts, while examining the institutional and procedural mechanisms established for the protection of personal data in the digital environment. It also discusses the rights granted to data subjects and the obligations imposed on entities responsible for data processing, in addition to the challenges facing the implementation of data protection rules in light of the continuous development of digital technologies. The study concludes that the effectiveness of personal data protection in the digital space requires strengthening the legislative framework, developing monitoring and enforcement mechanisms, and promoting legal and digital awareness among individuals and institutions. Such measures are essential to ensuring a balance between benefiting from modern technologies and safeguarding the right to privacy
