الحماية القانونية للأم العاملة في التشريع الجزائري

Abstract

ملخص الدراسة: تتناول هذه الدراسة موضوع الحماية القانونية للأم العاملة في التشريع الجزائري من خلال إبراز الإطار المفاهيمي والتشريعي الذي ينظم هذا الموضوع، مع توضيح مظاهر الحماية قبل الوضع وأثناءه وبعده. كما تسلط الضوء على الآليات القانونية والمؤسساتية التي تضمن تطبيق هذه الحماية مثل مفتشية العمل والقضاء والهيئات الداعمة. وتبين الدراسة أن المشرع الجزائري أولى أهمية خاصة للأم العاملة من خلال قوانين العمل والضمان الاجتماعي والدستور والاتفاقيات الدولية. كما تؤكد على أن هذه الحماية تهدف إلى تحقيق التوازن بين الحياة المهنية والأسرية. وتخلص إلى أن فعالية هذه الحماية تبقى مرتبطة بمدى احترام وتطبيق النصوص القانونية في الواقع العملي

Abstract : This study addresses the legal pro”ecti’n of working mothers in Algerian legislation by highlighting the co”cept’al and legislative framework gover”Ing this issue, while explaining the forms ”f protection before, during, and a”ter childbirth. It also sheds light on the legal and Institutional mechanisms that ensure the’implementation of this protection, such as the Labor Inspectorate, the judiciary, and supporting bodies. ”he study shows that the Algerian legislator has given special importance to workin” mothers through labor laws, social”security regulations, the constitution, and”international conventions. It also emphasizes that this protection aims to achie”e a balance between professional a”d family life. The study concludes that the effectiveness of this protection depends on the extent to which legal texts are respected and applied in practice.
