The first part focuses on establishing the conceptual and legislative framework for these amicable methods, determining their contractual nature, as well as their formal and substantive components. Furthermore, it deconstructs the legal status of the mediator and the regulations governing their duties, while distinguishing conciliation and mediation from similar systems such as arbitration and conventional litigation, in order to identify the distinct identity and procedural autonomy of these In the second part, the research shifts to the procedural framework and the legal effects of the outcomes of these methods. It tracks the radical legislative transformation brought about by Law No. 22-13. The study balances the optional nature of conciliation and mediation before ordinary commercial chambers with the mandatory enforcement of the conciliation session as a compulsory prerequisite for the admissibility of lawsuits before the specialized commercial courts. Additionally, it highlights the role of the presiding judge and the commercial assessors in managing these sessions. The study also reviews the executive force of agreement minutes and judicially sanctioned solutions, along with the available methods of appeal to guarantee transactional stability. The dissertation concludes by diagnosing the realistic legal, professional, and cultural impediments facing the activation of these alternative methods in the Algerian commercial environment, resulting from the novelty of this specialized system. Finally, the study offers a set of practical prospects and recommendations, primarily emphasizing the necessity of drafting legal frameworks for institutional and electronic mediation, qualifying human resources, and raising legal awareness regarding the feasibility of amicable solutions to foster a commercial climate built on speed and credit.
