Abstract
Summary:
This dissertation addresses the topic of the electronic contract as one of the most prominent manifestations of digital transformation in commercial transactions, where contracts have shifted from the traditional form based on physical presence to a modern form conducted through electronic means within the framework of e-commerce. This is achieved through a study that combines both the theoretical and practical dimensions of this contract in the digital environment.
From a theoretical perspective, the study clarifies the concept of the electronic contract and e-commerce, as well as their characteristics, while highlighting the nature of the electronic contract as a contract concluded remotely through electronic means. From a practical perspective, it examines its role in the formation and execution of commercial transactions, with a focus on the main legal mechanisms for protecting parties, especially the electronic consumer, in addition to the sanctions resulting from breach of contractual obligations.
Finally, the study concludes that the electronic contract has become an effective and recognized legal instrument in the conclusion of commercial transactions. However, the legal framework governing it still requires further development in order to keep pace with rapid digital transformations and ensure effective protection for the parties involved in contractual relationships
