Abstract

Abstract: The civil liability of the shipowner in Algerian legislation constitutes a fundamental pillar of maritime law operation, aiming to protect victims of maritime operation damages such as pollution, collision, and cargo and passenger transport accidents. This liability, derived from maritime law and the general rules of the civil code, is based on three main elements: fault (whether personal by the owner or Committed by subordinates like the captain and crew), damage caused to third parties, and the causal link connecting them. In return, the Algerian legislator balanced victims' rights with the encouragement of investment in maritime navigation. It established cases to exempt the owner or mitigate their liability upon proof of force majeure, the fault of the victim, or a foreign cause. Furthermore, the law granted the shipowner an exceptional advantage represented by the right limit their financial liability in certain cases. This protects commercial activity from catastrophic losses and ensure the stability of maritime transaction, influenced by the international maritime conventions govering these limits. The paramount importance of these rules lies in providing a balanced legal environment that aligns with the rapid development of maritime transport and international trade
