Abstract

ملخص مذكرة الماستر تتناول هذه المذكرة موضوع المسؤولية الجنائية للموظف العمومي في جرائم الفساد في التشريع الجزائري، من خلال دراسة مفهوم الموظف العمومي وجرائم الفساد، وبيان الأساس القانوني للمسؤولية الجنائية وأركان قيامها وفق أحكام قانون الوقاية من الفساد ومكافحته وقانون العقوبات. كما تبرز أهمية تجريم الأفعال التي تمس نزاهة الوظيفة العامة وحماية المصلحة العامة والمال العام. كما تتطرق الدراسة إلى أهم صور جرائم الفساد التي قد يرتكبها الموظف العمومي، وعلى رأسها الرشوة والاختلاس واستغلال النفوذ وإساءة استغلال الوظيفة، مع بيان العقوبات المقررة لها والآثار القانونية المترتبة عنها. وقد خلصت إلى أن المشرع الجزائري اعتمد سياسة جنائية تهدف إلى مكافحة الفساد وتعزيز مبادئ الشفافية والنزاهة داخل المرافق العامة

This dissertation examines the criminal liability of public officials for corruption offenses under Algerian legislation by studying the concept of the public official and corruption crimes, as well as the legal basis and elements of criminal liability in accordance with the Anti-Corruption Law and the Penal Code. It highlights the importance of criminalizing acts that undermine public integrity and harm public interests and public funds. The study also addresses the main forms of corruption offenses committed by public officials, particularly bribery, embezzlement, influence peddling, and abuse of office, while presenting the sanctions and legal consequences resulting from such crimes. It concludes that Algerian legislation has adopted a criminal policy aimed at combating corruption and strengthening the principles of integrity and transparency within public institutions
