Abstract
Modern methods of proof have become one of the most prominent outcomes of the contemporary technological and scientific revolution, imposing themselves as an indispensable necessity within the judicial system to keep pace with rapid digital developments. These modern tools—such as electronic evidence and fingerprints—have contributed to facilitating crime detection and resolving disputes with accuracy. However, this rapid development has been accompanied by numerous legal and procedural challenges, particularly regarding their admissibility before courts, and the extent of the judge’s discretionary power to form an intimate conviction, without prejudice to human rights and constitutional guarantees. Accordingly, this study seeks to shed light on the legal regime of modern methods of proof and the role of judicial expertise in analyzing them, focusing on the reality of their application within Algerian legislation. It also aims to identify the technical and legal obstacles facing the judge, to establish a framework that ensures the effective use of these technologies while achieving justice and safeguarding fundamental rights and freedoms.
