Abstract

Abstract of The master thesis This study addresses the subject of expropriation for public utility as one of the most significant prerogatives granted to public authorities to achieve the public interest and implement development projects. It aims to clarify the legal framework governing expropriation procedures under Algerian legislation, while highlighting the safeguards established to protect individuals’ rights against administrative abuse during the exercise of this power. The study adopts both descriptive and analytical approaches through the examination of the legal and regulatory texts governing expropriation, as well as the analysis of relevant judicial decisions. The findings reveal that the Algerian legislator has surrounded the expropriation process with a set of legal conditions and procedures intended to strike a balance between the requirements of public utility and the protection of private property rights. Nevertheless, practical application continues to raise certain issues, particularly regarding the assessment of compensation and the effectiveness of judicial review over expropriation decisions. The study recommends strengthening judicial oversight of administrative actions, modernizing compensation assessment mechanisms to ensure fairness for affected property owners, and simplifying legal procedures in a manner that facilitates the timely implementation of public utility projects without infringing upon individual rights
