Abstract

مــلخص مذكرة الماستر تتناول هذه المذكرة موضوع الأحكام القانونية المنظمة لمهنة التوثيق في التشريع الجزائري، في ظل القانون رقم 06-02 المتعلق بتنظيم مهنة الموثق، باعتبارها من المهن القانونية ذات الطابع الرسمي التي تلعب دورًا محوريًا في تأمين المعاملات المدنية والتجارية وضمان استقرارها. وقد هدفت الدراسة إلى إبراز الإطار القانوني الذي يحكم مهنة التوثيق من حيث شروط الالتحاق بها، وتنظيمها الهيكلي، والاختصاصات الممنوحة للموثق، إضافة إلى بيان طبيعة المسؤولية المترتبة على ممارستها. ان الجوانب المتعلقة بضمان حجية المحررات التوثيقية، ودور الموثق في إضفاء الرسمية على العقود، بما يضمن حماية الأطراف المتعاقدة والحد من النزاعات. وتم التطرق كذلك إلى الضمانات القانونية والأخلاقية التي تحكم أداء الموثق، وعلى رأسها الالتزام بالحياد، والسر المهني، واحترام قواعد المهنة. أن المشرع الجزائري من خلال القانون 06-02 قد سعى إلى إرساء منظومة قانونية دقيقة توازن بين منح الموثق صلاحيات واسعة في تحرير وتوثيق العقود، وبين إخضاعه لرقابة صارمة تضمن حسن أداء الخدمة العمومية التوثيقية وتحقيق الأمن القانوني للمعاملات

Abstract of The master thesis This thesis addresses the legal provisions governing the notarial profession within Algerian legislation, in light of Law No. 06-02 regulating the notarial profession. The notarial profession is considered one of the legal professions of an official nature, playing a pivotal role in securing civil and commercial transactions and ensuring their stability. The study aims to highlight the legal framework governing the notarial profession in terms of admission requirements, its organizational structure, the powers granted to the notary, as well as the nature of liability arising from its practice. The study also examines aspects related to ensuring the evidentiary value of notarial instruments and the role of the notary in granting authenticity to contracts, thereby ensuring the protection of contracting parties and reducing disputes. It further addresses the legal and ethical guarantees governing the notary’s performance, most notably the obligation of neutrality, professional secrecy, and respect for professional rules. The Algerian legislator, through Law No. 06-02, has sought to establish a precise legal framework that balances granting the notary broad powers in drafting and authenticating contracts while subjecting him to strict supervision, in order to ensure the proper performance of the notarial public service and achieve legal security in transactions
