Abstract

This master's thesis examines the subject of digital platform contracting as one of the most significant manifestations of digital transformation in modern legal and commercial transactions. The study aims to identify the legal framework governing contracts concluded through digital platforms by analyzing their concept, characteristics, and legal elements, as well as the legal effects arising from such contracts. Particular attention is given to issues related to electronic evidence, judicial jurisdiction, and the applicable law.
The research adopts a descriptive and analytical approach through the examination of national and international legal texts regulating electronic contracting, together with relevant doctrinal opinions and judicial practices. The study also addresses the legal safeguards designed to protect contracting parties and enhance trust in the digital environment.
The study concludes that contracting through digital platforms has become an essential legal and economic reality, requiring continuous legislative development to keep pace with technological advancements, strengthen electronic evidence mechanisms, and provide effective legal protection for consumers and electronic users, thereby ensuring legal certainty and stability in digital transactions.
